Refund policy

 

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day

  • on which you or a third party designated by you, other than the carrier, took possession of the goods, or
  • if several goods were ordered as part of a single order and delivered separately: on the day on which you or a third party designated by you, other than the carrier, took possession of the last goods.

To exercise your right of cancellation, you must inform us (Aigner und Fuchs Watches GbR, Hoffeldweg 16, 94036 Passau, Germany, e-mail: info@aigner-fuchs.com, telephone: +49 151 61600155) by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to cancel this contract.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

We ask you to take the goods to the post office within a maximum of 7 working days after declaring your cancellation and to provide us with proof of shipment. If the return is made late or without proof of shipment, the customer shall bear the risk of any resulting loss in value or delay in processing.

Consequences of Cancellation

If you cancel this contract, we shall reimburse you for all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choosing a type of delivery other than the standard delivery offered by us).

The refund will only be made from the day on which we have actually received the returned goods. From that date, we have up to 14 days to process the refund.

For the refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of the refund.

Return of Goods

You must return or hand over the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you dispatch the goods before the fourteen-day period has expired.

You shall bear the direct costs of returning the goods.

The customer undertakes to always return the goods using insured shipping and to ensure that the product arrives at our premises undamaged. Upon prior agreement, we will provide a return shipping label for standard shipping.

Special provisions for watches with a value exceeding €3,999:

  • Returns may only be made through the specialised valuables logistics provider INTEX.
  • We will arrange the collection for you – please contact us in advance at info@aigner-fuchs.com.
  • If the return is made using another shipping provider (e.g. DHL, UPS, Hermes, etc.), the customer shall bear the full risk of loss or damage to the goods during transport.
  • The cost of insured return shipping via INTEX (approximately €160–€200) shall be borne by the buyer.

Liability for Diminution in Value

You shall only be liable for any diminution in the value of the goods if this diminution in value results from handling of the goods that was not necessary to establish their nature, characteristics and functioning.

This applies in particular if:

  • the watch shows signs of use, water damage or external damage (the water resistance of the watch does not apply to use in a sauna or during hot bathing, such as in whirlpools or thermal baths. Vapour can also damage water-resistant watches),
  • the watch is returned inadequately packaged and is damaged as a result,
  • the watch is damaged through improper handling (e.g. overwinding the crown),
  • the watch has been opened (regardless of by whom),
  • the watch shows scratches or dents,
  • the watch fogs up or develops condensation because, for example, the crown was not properly screwed in,
  • the watch has been dropped,
  • the watch develops condensation, fogs up or suffers other moisture- or temperature-related damage as a result of improper or non-recommended use, in particular exposure to extreme heat or cold, significant temperature fluctuations, moisture, water or heavy perspiration,
  • the watch is damaged or its functioning is impaired as a result of improper handling, unauthorised intervention or attempted repairs.

Please therefore ensure that the watch is packaged securely and in a shock-resistant manner and handled with appropriate care.

Due to the age and nature of the watches offered, it is expressly pointed out that the watches are not recommended for use in extreme temperatures or significant temperature fluctuations. In particular, we advise against wearing the watches at temperatures below 0 °C or above 30 °C. Significant temperature changes may, particularly in older watches, cause condensation to form inside the case and the watch crystal to fog up. This may occur, for example, when moving from cold outdoor conditions into strongly air-conditioned indoor premises or vice versa.

The watches are generally not water-resistant unless a different characteristic is expressly stated in the respective product description. Even where a watch is expressly described as water-resistant or waterproof, the respective specification must be observed in consideration of the age and condition of the watch, and the watch must be handled with appropriate care.

Heavy perspiration on the wrist may also cause moisture to penetrate the case and condensation to form inside the watch. The customer must therefore handle the watch in accordance with its described characteristics and taking into account its age and condition, and protect it from moisture, water, significant temperature fluctuations, as well as extreme heat and cold.

Mechanical watches may become magnetised during transport due to influences occurring during the shipping process. Magnetisation may cause the watch to exhibit significantly inaccurate timekeeping after delivery, including running fast, running slow or temporarily stopping.

If a watch appears to be affected by possible magnetisation after receipt or stops running, the customer is required to have the watch first inspected by a qualified watchmaker for possible magnetisation and, if necessary, professionally demagnetised. If the watch continues to exhibit a functional impairment after professional demagnetisation, the customer must notify us without undue delay and coordinate the further procedure with us.

The customer must refrain from opening or attempting to repair the watch independently or having it opened or repaired by unauthorised persons.

Inspection of Returned Goods

Every returned watch will be thoroughly inspected by us. This inspection may take up to 4 weeks.

The refund will only be made after completion of the inspection and, where applicable, after deduction of compensation for any diminution in value.

Notes on Warranty & Liability

  • A manufacturer's warranty only exists if this is expressly stated in the product description.
  • We do not provide any warranty for water resistance unless this is expressly stated.
  • Our liability is limited to the condition of the goods at the time of handover.
